This website operating under the name Myluxurybreak.com, the content and infrastructure of all pages, all services offered and the online accommodation reservation service, where available, provided on these pages (the service) are owned, operated and provided by Azure Resorts Ltd, here in after referred to as Myluxurybreak.com (us, we or our) and are provided for your personal, non-commercial use only, subject to the terms and conditions set out below.
1. Scope of our Service
Through this website, Myluxurybreak.com and suppliers provide an online platform through which all types of services, temporary accommodation, including but not limited to, hotels, motels, bed & breakfasts, Villas, and Apartments, can advertise their rooms and services for reservation, and through which visitors to the website can make such reservations. By making a reservation through Myluxurybreak.com, you enter into a direct (legally binding) contractual relationship with the supplier with whom you book. From the point at which you make your reservation, we act solely as an intermediary between you and the Supplier, transmitting the details of your reservation to the selected Supplier and sending you a confirmation email for and on behalf of the Supplier in accordance with the terms and conditions of the selected service/accommodation.
The information we disclosed on the Website describing the services is information provided to us by the Suppliers. Therefore the suppliers are fully responsible for updating such information, including all rates, availability dates and other information which is displayed on our website. Although we will use reasonable skill and care in providing accurate information we will not verify if, and cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our website or otherwise), inaccurate, misleading or untrue information or non-delivery of information. Each Supplier remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information (including the rates and availability) displayed on our website. Our website does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level, qualification or (star) rating of any accommodation made available.
The services made available on the website are for personal and non-commercial use only. Therefore, you are not allowed to re-sell, deep-link, use, copy, monitor (e.g. spider, scrape), display, download or reproduce any content or information, software, products or services available on our website for any commercial or competitive activity or purpose.
2. Privacy and cookies
Myluxurybreak.com uses high ethical standards and respects your privacy. Save for disclosures required by law in any relevant jurisdiction and the disclosure of your name, email address and your credit card details for completing your booking with the relevant accommodation of your choice, we will not disclose your personal information to third parties without your consent. However, we reserve the right to disclose your personal information to our affiliated (group) companies (in and outside the European Union), including our affiliated (group) companies' employees and our trusted agents and representatives who have access to this information with our permission and who need to know or have access to this information to perform our service (including customer services and internal (audit/compliance) investigation) to and for the benefit of you. Furthermore, in order to offer the users of our website an advanced and user-friendly website that adapts automatically to the user's needs and wishes, we use cookie n our website.
3. Credit Card
In connection with your service request, you will be asked to provide customary billing information such as name, billing address and credit card information either to Myluxurybreak.com or its third party payment processor. You agree to pay Myluxurybreak.com for any confirmed bookings made in connection with Myluxurybreak.com in accordance with these Terms by credit card. You hereby authorize the collection of such amounts by charging the credit card provided as part of requesting the booking, either directly by Myluxurybreak.com or indirectly, via a third party online payment processor.
Please note that Myluxurybreak.com cannot control any fees that may be charged to a Guest by his or her bank related to Myluxurybreak.com collection of the Total Fees, and Myluxurybreak.com disclaims all liability in this regard.
The suppliers, not Myluxurybreak.com, are solely responsible for honouring any confirmed bookings and making available any accommodations and/or Service reserved through the Myluxurybreak.com. If you, as a Guest, choose to enter into a transaction with a Suppliers for the booking of an Accommodation and/or Service, you agree and understand that you will be required to enter into an agreement with the Suppliers and you agree to accept any terms, conditions, rules and restrictions associated with such Accommodation and/or Service imposed by the Suppliers. You acknowledge and agree that you, and not Myluxurybreak.com, will be responsible for performing the obligations of any such agreements, that Myluxurybreak.com is not a party to such agreements, and that, with the exception of its payment obligations hereunder, Myluxurybreak.com disclaims all liability arising from or related to any such agreements. You acknowledge and agree that, notwithstanding the fact that Myluxurybreak.com is not a party to the agreement between you and the Supplier; Myluxurybreak.com acts as the Supplier payment agent for the limited purpose of accepting payments from you on behalf of the Supplier. Upon your payment of amounts to Myluxurybreak.com which are due to the Supplier, your payment obligation to the Supplier for such amounts is extinguished, and Myluxurybreak.com is responsible for remitting such amounts, less Myluxurybreak.com fees, to the supplier. In the event that Myluxurybreak.com does not remit any such amounts to a Supplier, such Supplier will have recourse only against Myluxurybreak.com.
By making a reservation and/or service request with an supplier, you accept and agree to the relevant cancellation and no-show policy of that Supplier, and to any additional (delivery) terms and conditions of the supplier that may apply to your reservation or during your stay, including for services rendered and/or products offered by Myluxurybreak.com (the delivery terms and conditions of an Supplier can be obtained from the relevant Supplier). The general cancellation and no-show policy of each supplier is made available on our website on the accommodation and/or Services information pages, during the reservation procedure and in the confirmation email. Please note that certain rates or special offers are not eligible for cancellation or change. Please check the room details thoroughly for any such conditions prior to making your reservation.
If you wish to review, adjust or cancel your reservation, please revert to the confirmation email and follow the instructions therein. Please note that you may be charged for your cancellation in accordance with the Supplier cancellation and no-show policy. We recommend that you read the cancellation and no-show policy of the supplier carefully prior to making your reservation.
5. Further correspondence
By completing a booking, you agree to receive (i) an email which we may send you shortly prior to your arrival date, giving you information on your destination and providing you with certain information and offers (including third party offers to the extent that you have actively opted in for this information) relevant to your booking and destination, and (ii) an email which we may send to you promptly after your stay inviting you to complete our guest review form. Other than the email correspondence confirming your booking, relevant booking modifications or cancellation emails, including reminder emails in instances where you have not finalised a booking, communications initiated from us or the a supplier regarding your booking, guest review invitations, and the emails for which you may have actively opted in, we shall not send you any further (solicited or unsolicited) notices, emails or correspondence, unless you specifically agree otherwise.
Subject to the limitations set out in these terms and conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our services, up to an aggregate amount of the aggregate cost of your reservation as set out in the confirmation email (whether for one event or series of connected events).
However and to the extent permitted by law, neither we nor any of our officers, directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliate (distribution) partners, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise making available the site and its contents shall be liable for (i) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy relating to the (descriptive) information (including rates, availability and ratings) of the accommodation as made available on our website, (iii) the services rendered or the products offered by the accommodation provider, (iv) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our website, or (v) for any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, willful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the accommodation (its employees, directors, officers, agents, representatives or affiliated companies), including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.
Unless stated otherwise, the software required for our services, or available at, or used by our website and the intellectual property rights (including the copyrights) of the contents and information of, and material on, our website are owned by Myluxurybreak.com, its suppliers or providers.
To the extent permitted by law, these terms and conditions and the provision of our services shall be governed by and construed in accordance with British Virgin Island law and any dispute arising out of these general terms and conditions and our services shall exclusively be submitted to the competent courts in British Virgin Islands.
The original English version of these terms and conditions may have been translated into other languages. The translated version is a courtesy and office translation only and you cannot derive any rights from the translated version. In the event of a dispute about the contents or interpretation of these terms and conditions or inconsistency or discrepancy between the English version and any other language version of these terms and conditions, the English language version to the extent permitted by law shall apply, prevail and be conclusive. The English version is available on our website (by selecting the English language) or shall be sent to you upon your written request.
If any provision of these terms and conditions is or becomes invalid, unenforceable or non-binding, you shall remain bound by all other provisions hereof. All of our services are rendered by Azure Resorts Ltd., which is a private limited liability company, operating as myluxurybreaks.com is incorporated under the laws of the British Virgin Islands and having its administration offices at Azure Service Ltd. C/o.
Myluxurybreak.com is part of a group of companies with various subsidiaries throughout the world. The subsidiaries only provide an internal supporting role to and for the benefit of Myluxurybreak.com. The subsidiaries do not have any power or authority to render the service, to represent Myluxurybreak.com or to enter into any contract in the name of, for or on behalf of Myluxurybreak.com. The subsidiaries do not operate and are not authorised to act as any form of process or service agent of Myluxurybreak.com. Myluxurybreak.com does not accept nor assume any domicile at any place, location or office in the world (also not at the office of its subsidiaries), other than its registered office in British Virgin Islands.
All advertised pricing on Myluxurybreak.com is a starting price, if and when booking the actual cost of your holiday might be slighly higher or lower than advertised. This is due to seasonal rates and property availability.
10. Data Protection
